ZARC had no involvement and was dismissed from Frank Ward case in Oregon.

In 1993 Debora Ward brought a suit in Multnomah County Circuit Court, Oregon, case 9303-01609 against various defendants (SNC Distributors, Inc. Dallett Holding, Inc., Aerko International, Gardner Whitcomb, dba Luckey Police Products and Zarc International, Inc.) regarding the death of Officer Frank Ward of John Day Police Department who was killed while responding to a domestic violence call, by the husband who later pled guilty to murder.

Zarc International, Inc. (ZARC) was dismissed from the trial of this case because ZARC had no prior involvement with this incident and did not sell or provide any product or training services. The pepper spray canister found on Officer Frank Ward was not manufactured by ZARC, but Aerko International and sold by Luckey Police Products through its distributor SNC Distributors, Inc. Officer Frank Ward had received training in the use of pepper spray not from ZARC, but via a video developed internally by an Oregon Police Department.

ZARC was later engaged as an expert witness to testify at jury trial. No concrete evidence was ever presented as to whether pepper spray was ever used by Officer Frank Ward
